The company that builds your house charges you an additional price

When you started digging, the company you entrusted with the construction of your house found deep embankments, which requires special foundations. She refuses to perform them for free by taking refuge behind her contract, where it is stated that the price does not include any additional foundation work. However, you turned to a builder who took care of everything, plans and construction.

The clause of the contract invoked by the builder does not comply with the regulations. The builder who proposes to build on your land according to the plans he himself has provided is required to examine the land beforehand and to make an estimate of the work, taking into account the necessary adaptations.

recommended letter with receipt note

Dear,

On (date), I signed a contract with your company for the construction of a single-family house with provision of a plan governed by Articles L. 231-1 et seq. Of the Construction and Housing Code.

By letter dated (…), you tell me to refuse, on the basis of the price fixed in the contract, the execution of special foundations following the discovery of deep embankments.

Article L. 231-2, c, of the same code indicates that you must provide the description and estimate of the cost of the external equipment works which are essential for the establishment of the construction. So you had to personally check the condition of the land, which you did not do.

Consequently, I do not accept the increase you are claiming from me, especially since the price indicated in the contract is a fixed price.

Please accept, Madam, Sir, the expression of my best regards.
