You ask for payment terms from the bank that loaned you the money

 

You borrowed money to buy an apartment. Then you took out a second loan to acquire a car. But, today, you can no longer repay your monthly payments. Make proposals to your creditors to rearrange the schedule. If they refuse, write to them to remind them that the credit law allows the magistrate to grant you payment delays. If your letter is not more successful, go to the district court in your place of residence.

 

Article L. 313-12 of the Consumer Code allows the judge:

 

to grant you the suspension of repayments for a maximum of two years;

 

to decide that, during the grace period, the sums due will not generate interest;

 

to fix the terms of reimbursement of the sums carried over.

 

Don't wait for the first delinquency to alert your banker. If you foresee a reduction in your resources, ask for an arrangement right away: you will avoid late interest. The judge can also give you a deadline before the unpaid, once your concerns are justified.

On (date), I took out with your establishment a credit agreement of (…) euros for the purchase of a car.

 

As I indicated to you by telephone and in a previous letter, I am currently going through financial difficulties which make me temporarily unable to repay my monthly installments.

 

My request for postponement of these deadlines not having received your agreement, I see myself compelled to apply to the magistrate to ask him for a suspension of payment on the basis of article L. 313-12 of the Consumer Code.

 

However, before taking it up, I ask you to reconsider your position. To this end, I am enclosing a costed and dated redevelopment proposal.
