The villa you rented for the holidays does not correspond to the description received

You arrive at your vacation spot and discover that the rental you have booked does not match the description given to you. If possible, have it verified by a bailiff, but other methods of proof can be equally effective: photos, videos, testimonials. You will request compensation from the owner, by registered letter with acknowledgment of receipt.

When the deception is manifest, you can file a complaint by writing to the public prosecutor of the district court of the place of the rental:

- or for providing clearly inaccurate information, if it was given to you in private correspondence. This offense is punishable by a fine of 3,750 euros (decree n ° 67-128 of February 14, 1967);

- or for deceptive commercial practice, if they have been disseminated by a professional, by way of advertisement.

recommended letter with receipt note

Dear,

It was with great disappointment that my family and I discovered the "calm villa, on the seafront", to use your own words, which we had reserved for the holidays and for which we had made a significant financial effort. .

In fact of villa, it is about a prefabricated shed, separated from the sea by an expressway and, above all, located near a discotheque which closes only at dawn. We couldn't stay there longer than forty-eight hours. This is why I am asking you for the full reimbursement of the price of this rental, as well as compensation of (…) euros, corresponding to (name and justify the unforeseen expenses that you had to incur).

I remind you that providing manifestly inaccurate information about a vacation rental is liable to criminal penalties, and that I would be entitled to lodge a complaint and claim damages.

Please accept, Madam, Sir, the expression of my best regards.
