The services provided during an organized trip are modified on site

 

When, during a package trip, the organizer is unable to provide overriding services, he must seek replacement services and offer them to you at no additional cost, or even by reimbursing the overpayment. However, you are free to accept or reject these changes.

 

The Tourism Code (articles L. 211-15 and R. 211-11) provides for two possibilities:

 

- either you accept the modification: the travel agency must then, depending on the case, either reimburse you for the difference, when the service is less than what was planned, or pay the additional price, when the service is higher than expected;

 

- or you refuse the modification: the agency must then provide you with the transport tickets necessary for your immediate return, and you can claim damages from it for the damage suffered.

I was registered for a trip to (country) for the period from (date) to (date).

 

(1st case) I had to be lodged at the hotel (name). However, I was accommodated at the hotel (name), which is of a lower category. I therefore ask you to reimburse the price difference between these two hotels, as provided for in Article L. 211-15 of the Tourism Code.

 

(2nd case) The hotel in which I was to be accommodated being full, I was offered to spend my vacation at the hotel (name), located far from the sea, in a very noisy area. I refused this modification and I returned immediately, thanks to the plane ticket you gave me. The fact remains that this long-planned trip was canceled and my vacation was ruined. I therefore ask you to reimburse me for the full amount I paid you.
