In Islam,
polygamy is permissible under certain conditions, however, with various
restrictions including the payment of dowries, the obligation to provide for
wives and children, and a maximum of four wives simultaneously. The Prophet
Muhammad was polygamous and had thirteen wives, although not simultaneously.
Polygyny is not specifically promoted and the Koran has merely imposed
additional conditions in relation to past practices. Monogynic foci are
predominant and this tendency is accentuated16, probably by a stricter reading
of verse 4.12917, but also probably as a result of the antipolygamic struggles
of feminist associations and movements in contemporary Muslim societies
Polygamy in
Muslim Law
Even though
polygamy today is mostly associated with Islam, the latter has not invented it.
This practice existed in the Arabian peninsula before the advent of the latter.
Indeed, polygamy was widespread in pre-Islamic Arab society. Consequently, it
was "difficult for Islam, if not impossible, to radically change what
constitutes the fundamental piece of the family, namely the institution of
marriage", which explains the absence in the Qur'an of a formal
prohibition of this practice. Taking into account the historical context, one
could say that Islam was above all to regulate polygamy by limiting the maximum
number to four wives.
Polygamy in
the Muslim World
Muslim
countries have adopted measures to restrict and discourage polygamy.
Turkey and
Tunisia abolished it, while other countries made it more difficult. Moroccan
law, since the revision of the family code, Modawhanna, in 2004, considers
"polygamy as an impediment to marriage". Under the new law, a woman
has the right to demand that her husband renounce polygamy at the time of
signing the marriage contract (art. 40). In addition, a man who plans to marry
another woman must have court authorization as well as the agreement of the
current wife and the future wife (Arts 40-46). It should be emphasized that
even if polygamy is rarely practiced, "the Moroccan legislator, like its
counterparts in other Arab countries, has not dared to completely abolish this
institution" 5.
At the level
of Egyptian law, the wife has the option to require in the marriage contract
that the husband does not take a second wife and, if the husband violates this
obligation, the first wife has the opportunity to apply for a divorce6.
Therefore, with the exception of Muslim countries in sub-Saharan Africa, the practice
of polygamy is rather rare in most Muslim countries because of a less lax
interpretation of verse 129 of sura 4 and, on the other hand, because of the
difficult socio-economic conditions prevailing in most contemporary Muslim
societies7.
